Department of Post refusing to follow High Court’s order to withdraw derecognition of NFPE

As reported by AIFAP on 11th May 2024, Jharkhand High Court in its order of 12th April 2024 had stayed the order of the Department of Posts, Government of India, derecognising the majority recognised federation of postal employees , National Federation of Postal Employees ( NFPE) and its affiliate Union, All India Postal Employees Union ( AIPEU) Group C.

The judgement of the Jharkhand High Court clearly stated that the grounds on which AIPEU recognition was withdrawn on 26th April 2023 by the Department of Posts for supporting Kisan Andolan of 2020-2021, giving donation to CITU, etc. are not valid under law.

However, the Department of Posts on 19th April 2024 filed a petition at Jharkhand High Court to vacate the stay order. This petition was rejected by the Jharkhand High Court on 14th June 2024.

The NFPE filed a petition on 15th May 2024 for contempt of court against the Department of Posts for not following the High Court’s order which had stayed the de-recognition of NFPE.

Accordingly, the Jharkhand High Court has issued a contempt notice on 23rd August 2024 to the Department of Posts and asked it to give a reply within three weeks.

All this shows that the Central Government’s Department of Posts is refusing to obey the orders of the Jharkhand High Court which clearly states that the grounds on which NFPE was derecognised are not valid under law.

The Central Government’s own department is violating the laws of the land in order to crush any opposition from its own employees.
