17 unions of Maharashtra electricity workers, engineers and officers come together to strongly condemn the illegal circular prohibiting agitations and strikes and demand its immediate withdrawal

Mahavitaran’s circular attacking the right of workers to collectively fight their demands must be condemned. Their threat that the participation is any agitation/strike will lead to break in service and denial of many other benefits is draconian. All workers must stand with electricity workers in opposing such oppressive measures.

Subject: Regarding illegal and unjustified notices issued regarding Break in Service

Reference:- Circular No./Shini-4/2026/5555 dated 13.02.2026

The constitutional right to protest and, in cases where the demands are not met after discussion, to strike in accordance with the labour laws has been given to all Indian citizens under Articles 19 (1) (a), 19 (1) (e) and 19 (1) (b) of the Constitution of India. The Trade Union Act, 1926 provides the legal rights and privileges to registered organizations to hold collective discussions, bargain and strike. Legal protection has also been provided.

As per the Mahavitaran circular, if any employee registers participation in a collective agitation, it will be considered as direct punishment or break in service and thus the pay fixation will be taken back to the original stage, higher pay scale benefits will be withdrawn, service benefits for promotion will be removed, final gratuity will be fully or partially forfeited, criminal case may be registered, and workers may be dismissed from service. This is completely illegal, unconstitutional, violates the principles of natural justice and is against fair labor practices. According to the labour law, no action affecting the service conditions of the workers can be taken without a court order.

Due to the circular in question and its illegal provisions, the constitutional right to form an organization and to protest will be taken away from the workers, and this circular is in violation of the rights granted by the Constitution. Therefore, since the circular in question is the culmination of all these illegalities and is completely unjust, it is imperative to immediately withdraw and cancel this circular in order to maintain the integrity of the Constitution and the law.

The Action Committee strongly condemns this circular and strongly demands that it be immediately withdrawn and cancelled.

We request you to consider our demand positively and approve it so that industrial peace and harmony are not disturbed.
