Haryana Power Engineers Association Demands Total Transparency in Parallel Electricity Distribution Licensing Case for Gurugram and Nuh
PANCHKULA: The Haryana Power Engineers Association (HPEA) has voiced serious concerns regarding recent developments in HERC Petition No. 30 of 2026, filed by Eleven Power Private Limited for obtaining a parallel electricity distribution license in the revenue districts of Gurugram and Nuh. The matter is currently under consideration before the Haryana Electricity Regulatory Commission (HERC).
Preemptive Caveat Raises Serious Questions
HPEA highlighted that Eleven Power has preemptively filed a caveat in the Hon’ble Punjab and Haryana High Court, apprehending potential legal challenges from power sector bodies such as the All India Power Engineers Federation (AIPEF), HPEA, and other employee and consumer organizations against future HERC orders.
Ravinder Ghanghas, General Secretary of HPEA, stated that filing a caveat against anticipated regulatory orders creates deep apprehensions among power engineers, utility employees, and consumers regarding the neutrality and fairness of the process. While acknowledging that a caveat alone does not imply a decision has already been finalized, HPEA demanded full transparency from HERC.
Questions Raised Over Technical Eligibility and Expert Committee Findings
Raising severe integrity and eligibility concerns regarding the applicant company, HPEA noted:
Zero Financial & Technical Track Record: Eleven Power reported zero turnover in FY 2025–26, possesses zero prior technical experience in power distribution, and holds assets primarily in the form of shares of a Medanta Group subsidiary (Global Health). HPEA asserted that HERC ought not to have entertained an application from a entity lacking independent technical capabilities.
Flawed Solvency Assessment: Questions were raised over the findings of the Expert Committee appointed by HERC. The committee reportedly combined two separate ₹1,000 Crore solvency certificates—one issued by a bank and another by a private firm—treating them as a aggregate ₹2,000 Crore solvency capability, which HPEA termed factually and financially incorrect.
Conflict of Interest: HPEA further pointed out conflict-of-interest allegations regarding committee members, including an instance where a member was allegedly drawing a pension from Bihar while concurrently receiving a salary from Uttar Pradesh. HPEA demanded a thorough inquiry into the payments made to committee members.
Core Demands of HPEA
HPEA called upon HERC to ensure that the licensing procedure remains completely impartial, transparent, and participatory:
No Hasty or Unilateral Decisions: The Commission must refrain from taking rushed or one-sided decisions on granting a parallel distribution license.
Access to Filings and Documents: All technical reports, financial assessments, and submissions relied upon in the proceedings must be shared transparently with all stakeholders.
Protection of Public Interest: Thorough evaluations must be conducted regarding the impact of parallel licensing on existing consumers, farmers, DISCOM employees, and the financial health of public sector DISCOMs.
Appointment of Regular Chairperson: Given the far-reaching policy and financial ramifications, no final order should be passed until a regular Chairperson is appointed to lead a fully constituted regulatory commission.
Call for Peaceful Democratic Action
Stressing that electricity distribution is a vital public utility and not merely a commercial licensing venture, HPEA affirmed its trust in the judiciary and regulatory framework while issuing a firm stance:
“Public interest and regulatory integrity must remain paramount. If decisions are pushed through without addressing the legitimate objections of engineers, power workers, consumers, and farmers, HPEA—alongside other employee unions, consumer forums, and farmer organizations—will be forced to initiate a widespread, peaceful, and democratic movement.”
